GENERAL TERMS AND CONDITIONS OF A CLIENT'S USE OF APARTMENT

MILO - MILO Bartosz Mickiewicz, seated in Radomsk, ul. Leszka Czarnego 6, which is a party to the Apartment Lease Agreement for a holiday or tourist stay concluded with the Client.

Client - a natural or legal person which is a party to the Agreement (Apartment Lease Agreement for a holiday or tourist stay), which is at MILO's disposal.

Apartment - a dwelling apartment, described in detail in the offer presented on MILO's website, leased by the Client for a temporary holiday or tourist stay.

§ 1

General decisions:

  1. The following general terms and conditions of use, hereinafter referred to as the Terms, are an integral part of the Apartment Lease Agreement for a holiday or tourist stay between the Client and MILO or a proxy representing MILO.
  2. MILO declares that pursuant to the agreement with the owner of the apartment, hereinafter referred to as the Apartment, it is entitled to lease the Apartment to Clients for short-term holiday or tourist stays as part of the management activities.
  3. Moreover, MILO shall provide services that are connected with the brief Apartment lease such as: marketing, advertising, maintenance of cleanliness, supervision and information.

§ 2

Booking:

  1. The current catalogue of Apartments for a short term holiday or tourist stay along with their detailed descriptions can be found on the website: www.apartamentymilo.pl
  2. The Client can book the Apartment on-line at www.apartamentymilo.pl or electronically (via e-mail) or by telephone.
  3. After booking the Apartment via e-mail, the Client receives the form. The booking confirmation is done by clicking the confirmation link contained in the aforementioned form, which is tantamount to conclusion of the Agreement.
  4. The offer and the specified prices are for information purposes only and do not constitute an offer within the meaning of Art. 66, Paragraph 1 of the Civil Code. The price must be confirmed by our consultant when booking the apartment by phone or online.

§ 3

Service fee and payment terms:

  1. The Apartment rental fee for a tourist stay is given in every form (§ 2, item 4 of the Terms).
  2. The approximate price indicated in the offer on the website and included in the booking form includes 8% tax on goods and services.
  3. The payment for the apartment rental includes:
    • Accommodation in the Apartment for a number of people specified in the booking form;
    • Utilities consumed by the Client and the accompanying people during the booking period;
    • Washing of bed linen and towels;
    • Final cleaning;
  4. The service does not include additional cleaning, additional exchange of linen and towels, cot renting, stay of an animal and the cost of the parking lot.
  5. When making the booking (§ 2, item 3 of the Terms), the Client shall be obliged to make a payment of the fee (30% of the price) to the bank account indicated in the booking form within 3 days - 72 hours. The booking fee is understood as the Apartment lease price, the one-time cost of preparing the Apartment and the rental fee for parking space (if applicable). If the fee is not paid for until the date indicated in the booking form, the booking shall be cancelled.
  6. If the booking fee is paid after the date indicated in the form the booking shall be restored, if MILO still has vacancies.
  7. The remaining part of the fee (70% of the stay) can be paid for by a bank transfer or on the day of the check-in.

§ 4

Changing and cancelling the booking by the Client:

  1. The booking date can be changed only when the new date proposed by the Client has not already been booked. In this case, the change is not subject to a surcharge.
  2. When it is impossible to change the booking date and the Client has terminated the Agreement, cancelled the booking or did not manage to meet the conditions of the Agreement (did not arrive at the hotel), MILO is entitled to deduct the 30% of the amount paid for the stay (booking fee).
  3. It is possible to change the booking date (if the apartments are available) at no cost up to 7 days before the scheduled arrival.
  4. If the Client withdraws from the Agreement through no fault of MILO, it bears the full cost of the booking.

§ 5

Changing and cancelling the booking by MILO

  1. MILO can change the booking date only in case of force majeure that prevents MILO from providing the service. Force majeure means: natural disasters, any public authority residing in the apartment for any purpose, strikes, wars and riots, deprivation of electricity, gas, heating or water. In such situations, MILO shall be obliged to propose a different date to the Client or withdraw from the Agreement by returning the paid deposit (booking cancellation).
  2. MILO reserves the right to provide alternative accommodation of similar surface parameters to the booked apartment in the same localization in exceptional situations (failures in the Apartment of random events). If the Client does not agree to substitute the Apartment, the Agreement shall be terminated and MILO shall return the advanced payment made by the Client.
  3. In the event of a change or cancellation of the booking for reasons not listed in items 1 or 2, MILO shall be obliged to pay a contractual penalty in the amount of the advance payment provided for each apartment.

§ 6

Client accommodation procedure:

  1. The stay in the Apartment starts at 3:00 P.M. on the first day of the booked term. The Client is obliged to accept the Apartment from MILO's representative at an hour agreed upon by the Parties, checking the technical condition and cleanliness. Local Offices are open during predetermined hours depending on the season and locality. The Client shall receive the required information in a notification. If the Client intends to arrive at an hour other than the Office opening hours, the Client must notify the employees about such a situation at least 24 hours prior to the arrival. Arrivals at late hours may be subject to a surcharge.
  2. MILO may charge the Client with a refundable deposit to secure any possible compensation claims. The deposit is paid when the Client accepts the Apartment. The deposit is interest-free and it is refunded when the Client checks out.
  3. The stay finishes at 11.00 A.M. on the last day of the booked period. The Client is obliged to return the keys to the Apartment by 11.00 A.M. (or a different hour determined with MILO's representative).
  4. The Client is obliged to use the Apartment in accordance with its intended purpose, not remove any of its furnishings and decoration elements. Moreover, the Client shall not make a copy of the keys to the Apartment during the stay.
  5. Smoking in the Apartments is prohibited. A tourist who shall not follow this regulation will be charged with PLN 200.00 which is an equivalent to the cost of washing the curtains and bedspreads in the Apartment.
  6. The Client shall be obliged to secure the Apartment before leaving it by closing the windows and the front door with a key. The Client shall make all things necessary not to lose the key.
  7. The Client agrees not to exceed the number of people staying with the Client in the Apartment. The maximum number of people for each room is specified in the catalogue on the website or in the booking form.
  8. The Client shall not keep animals in the Apartment (unless agreed otherwise with MILO's booking office). All MILO Apartments are under the non-smoking ban.
  9. The Client and people accompanying the Client are obliged to allow MILO's representative to make their temporary check-in.
  10. If any of the regulations is violated, MILO is entitled to deduct a payment for an undeclared person, costs of bringing the Apartment to its appropriate condition, as well as other damages from the deposit made by the Client. If the value of the aforementioned claims exceeds the deposit limit, the Client is obliged to pay the difference immediately.
  11. If the Client violates the regulations in an extreme manner or in the case of acts of hooliganism, MILO is entitled to terminate the Agreement with immediate effect and remove the Client along with the accompanying people from the Apartment in assistance of the Police. Item 9 shall apply accordingly.
  12. The Client shall be entitled to report all remarks and requests during the stay by phone. The telephone number and the Terms are included in the written information contained in the Apartment.
  13. The Client agrees to process its personal data for marketing purposes.
